My Freelancer's Terms and Conditions

These Terms and Conditions (referred to as "Terms & Conditions") outline the rules for accessing and using the My Freelancer website, including all content, features, and services provided by www.myfreelancer.com by My Freelancer. The terms “My Freelancer,” “we,” and “us” refer to My Freelancer International Ltd. and its subsidiaries, while “you” or “user” refers to anyone using the Site.

Please review these Terms & Conditions thoroughly before using the Site. By accessing the Site, creating an account, or selecting the option to accept these Terms & Conditions, you agree to be bound by them on behalf of yourself or, if applicable, on behalf of your employer or any organization. You also confirm that you have read and understood our Privacy Policy. If you do not agree with these Terms or the Privacy Policy, please hold back yourself from accessing or using the My Freelancer. Contact Our Customer Support if you have any questions regarding the Site or Terms.

Eligibility and User Requirements

• This Site is meant to be used by individuals who are at least 18 years old and legally able to enter making agreements. If you are between 13 and 17 years old, you may use the Site only under an account owned by a parent or legal guardian with their permission. Users under 13 years of age are not allowed accessing the Site or using any My Freelancer services.
• Additionally, access to the Site is restricted to individuals who are not subject to economic sanctions or trade restrictions by the United States, the European Union, or any other applicable jurisdiction.
• By accessing and using the Site, you confirm that you meet all the above eligibility requirements. If you do not meet these requirements, you are not allowed to use My Freelancer.

Key Definitions

• Buyers: Our valuable users who purchase services on My Freelancer.
• Custom Offers: Special proposals created by a Seller to meet specific needs or requests from a Buyer.
• Billboard Page: A page where Sellers describe their Billboard service, including its terms, and where Buyers can purchase the service and create an Order.
• Billboard Services: Freelancing Services offered by Sellers on My Freelancer.
• Order Page: The dedicated area for Buyers and Sellers to communicate regarding a specific service that has been ordered.
• Orders: Formal agreements between a Buyer and a Seller to deliver and receive any freelancing service.
• Sellers or Freelancers: Users who provide services on My Freelancer.

Overview (Key Terms in Summary)

• Only registered users can buy or sell services on My Freelancer. When creating an account, you agree to provide accurate, complete, and current information about yourself or your business and to update this information, as necessary.
• Creating an account for misleading or deceptive purposes is prohibited. You are solely responsible for all activities under your account and for securing your password.
• My Freelancer is not liable for any actions or inactions related to your account.
• Sellers set their own prices independently. Services on My Freelancer may start at a minimum price of US $5, My Freelancer reserves the right to establish a higher starting price within specific service categories.
• Sellers are expected to fulfill their Orders and should not cancel Orders frequently or without a valid reason, as this can negatively impact their ratings.
• Users must not offer or accept payments by any means other than My Freelancer.com.
• Buyers receive all rights to the completed work they order, unless the Seller specifies otherwise on their Billboard or if the Buyer and Seller agree differently.

Seller Essentials

• Sellers can create Billboards on My Freelancer, which allow Buyers to browse and purchase their services.
• In addition to Billboards, Sellers may also offer Custom Offers customized to specific Buyer requests.
• Revenue is credited to the Seller’s account upon completion of an Order.
• Sellers are not allowed to advertise their Billboards, Seller Pages, or any My Freelancer-related content through Google Ads.
• A Seller’s rating is based on Buyer reviews and their performance on the site. High ratings help Sellers achieve points, while consistently low ratings could result in account suspension. Admin has the right to add or subtract points by examining the seller’s performance.
• Sellers are expected to maintain a general liability insurance policy that sufficiently covers all potential risks related to providing their services.

Billboards

• Sellers have a limited number of active Billboards they can post on My Freelancer.
• All Billboards on My Freelancer are classified as User-Generated Content.
• My Freelancer reserves the right to remove Billboards or user accounts from the platform in case of Terms violations, including (but not limited to) the following:
  • a. Illegal or fraudulent services
  • b. Copyright or trademark infringement, and breaches of third-party Terms & Conditions reported through our Intellectual Property Claims Policy
  • c. Adult content, pornography, or any inappropriate material
  • d. Unintentional or intentional copies of other Billboards
  • e. Spam, nonsense, violent Billboards
  • f. Billboards that mislead Buyers.
  • g. Resale of restricted or regulated goods
  • h. Low-quality services or substandard deliveries
  • i. Promotion of My Freelancer or its Billboards by any illegal activities or any marketing practices that negatively impact our user relationships or partnerships.
• Billboards removed for any of the above violations may lead to Seller’s account suspension.
• Billboards permanently removed due to violations are ineligible for reactivation.
• Listings may be removed for violating Terms, showing poor performance, or user misconduct.
• Billboards can include website URLs within the Billboard description or requirements section, but only to approved domains. Any Billboard linking to websites with content that violates My Freelancer’s Terms will be removed.
• Each Billboard must have an appropriate, relevant image representing the service offered. Sellers must deliver services of the same quality as shown in their Billboard images. Downgrades in quality may result in reduced Seller ratings or a permanent ban on the account.
• Sellers can upload approved videos to their Billboards through the available management tools on My Freelancer.
• Eligible Billboards can offer Billboard Packages, allowing Sellers to present their services at different prices and formats.

Custom Offer

• Sellers have the option to create Custom Offers customized to meet a Buyer's specific needs.
• Each Custom Offer is fully defined by the Seller, including detailed service description, price, and expected delivery time.
• Custom Offers are sent directly from the conversation page.

Buyers Basics

• You are not allowed to offer direct payments to Sellers using payment systems outside of the My Freelancer platform.
• Buyers can request Seller a Custom Offer which addresses specific Buyer requirements. Buyers can also use brief features to ask for services. Services requested on My Freelancer must be an allowed service on My Freelancer.
• When placing an Order on the My Freelancer platform you can only use funds that are obtained from legal sources and are not, directly or indirectly, connected to any unlawful activities.

Payments / Purchasing

• You cannot offer Sellers to pay or make payment using any method other than through the My Freelancer.com site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support.

Payment Agreement

• By using the services offered on My Freelancer, clients agree to pay for all services marked as completed by My Freelancer.
• Clients confirm that they have thoroughly reviewed and accepted the details of while creating an account on My Freelancer.
• Once a service is marked as completed by My Freelancer, clients are required to pay the full amount which is pending.
• Clients agree not to start a dispute or initiate a chargeback for the payment with their credit card company.
• Clients acknowledge that services were delivered faithfully and according to the agreed terms at the time of purchase.
• Any disputes or concerns regarding the service must be resolved directly with My Freelancer before attempting a chargeback.
• Failure to comply with these terms may result in actions to recover any disputed funds.

Orders Basics

• An Order is marked as Complete after it is marked as “Delivered” and then accepted by a Buyer. An Order will be automatically marked as “Complete” if not accepted and no request for change was submitted within 3 days after the Order was marked as “Delivered”. The Buyer can extend such period by up to 5 additional days.

Handling Orders

• When a Buyer places an Order, the Seller is notified by email as well as notifications on the Site while logged into the account.
• Sellers are required to meet the delivery time they mentioned when creating their Billboards or Custom Offer, failing to do so will allow the Buyer to cancel the Order when an Order is marked as late, and it may also harm the Seller's ratings.
• Sellers must send completed files and/or proof of work when marking the Order as “Delivered.”
• Sellers should not misuse the Deliver Work button to sidestep Order guidelines described in these Terms. Using the “Deliver Work” button when an Order was not fulfilled may result in a cancellation of that Order after review, affect the Seller’s rating and result in a warning to Seller.
• Buyers are responsible for scanning all transferred files for viruses. My Freelancer will not be held responsible for any damage which might occur due to site usage, or transferred files.
• Buyers can use the "Request Revisions" feature located on the Order Page while an Order is marked as Delivered if the work delivered do not match the Seller's description on their Billboard Page or they do not match the requirements sent to the Seller at the beginning of the Order process.

Review System Guidelines

• Reviews from Buyers play an important role in My Freelancer’s rating and points system.
• Reviews can only be removed in cases where there is clear violation of our Terms.
• To make sure the honesty of our review system, all feedback must come from genuine and valid orders, as mentioned. Orders that are arranged with the goal to artificially boost Seller ratings or manipulate the Site may result in the permanent suspension of all accounts.
• Sellers are prohibited from refusing the delivery of services, files, or information necessary to fulfil Billboard’s service to obtain positive reviews. Pressurizing Buyers to remove their feedback is not allowed.
• After both Seller and Buyer have submitted their reviews, or once the given review period ends, all feedback becomes public.
• Work Samples can be showcased in a Seller's Billboard gallery on their Billboard Page if the Buyer opts to publish the Work Sample when leaving a public review. These Work Samples consist of images or videos provided to the Buyer within a delivery message.

My Freelancer Scoring System

• At My Freelancer, our scoring system for freelancers is designed to provide a thorough assessment that goes beyond client reviews. The scoring factors include:
  • a. Project completion rate: Assessing whether freelancers meet deadlines consistently.
  • b. Communication skills: Analyzing responsiveness, professionalism, and clarity in interactions.
  • c. Consistence of work quality: Making sure of a high standard of work across multiple projects.
  • d. Revisions and dispute resolution: Measuring how well freelancers handle client revisions and disputes.
  • e. Skills test results: Factoring in performance on platform-specific skills assessments.
  • f. Following rules: Freelancers who are obeying our guidelines and policies.
• This complete approach makes sure a fair and accurate reflection of a freelancer’s capabilities, giving clients a reliable basis for making informed hiring decisions.
• We assess the score of a freelancer by looking at their performance as mentioned above so that points can be added to the billboards of freelancers providing their services.

User Conduct and Community Guidelines

• My Freelancer empowers freelancers globally to create, share, sell, and buy a wide range of services at exceptional value.
• We strive to maintain a welcoming, community-oriented, and professional environment. Users are expected to uphold this spirit in all interactions and activities on My Freelancer. This section outlines the standards of conduct users are expected to follow when engaging with others on the platform.
• If you want to report a violation of our terms, encounter user misconduct, or have questions regarding your account, please reach out to our Customer Support team.

General Guidelines

• Sharing personal contact details, such as email addresses, phone numbers, or third-party messaging handles, to communicate outside of My Freelancer to bypass or misuse the My Freelancer messaging system or platform, is strictly prohibited.
• Any exchange of personal information which is needed to complete the service must be conducted within the Order Page on the platform.

Order Guidelines

• Users who place orders to damage the reputation of competing Sellers by leaving negative reviews will have those reviews removed. Additional actions may be taken against such accounts.
• Users are not allowed to pressurize previous Buyers or Sellers to change or remove reviews, or to cancel Orders in ways that are against our established Order Cancellation and Feedback policies.

Seller Content Warranty

• Sellers confirm that all content shown in their Services, Billboard Page, or Seller Page, is their own original work and does not violate the rights of any third parties.
• If Sellers use any music or pictures into their Service, Billboard Page, or Seller Page, they guarantee to have a valid license for its use, allowing them to include such media in their Billboards.
• Users should report Billboards that violate My Freelancer’s Terms, particularly if they suspect Billboard to be a duplicate of existing services (copycat Billboards). Such reports can be made via our reporting system or through Customer Support.

Violations

• Users may be issued a warning for breaching our Terms. This warning will be communicated via email and displayed on the user's account within the Site. While warnings do not restrict account activity, they may impact your access to certain features and benefits, result in the removal of your Billboards from our listings, or potentially lead to a permanent account suspension.

Prohibited Activities

• Adult Content & Pornography: My Freelancer strictly prohibits the exchange or promotion of adult content or pornographic materials.
• Inappropriate Conduct & Language: All communication on My Freelancer should remain respectful, positive, and professional. Harassment, bullying, or hate speech of any kind is not allowed. We provide users with tools to exchange messages, leave order ratings, and communicate on our Community Forum and social media platforms, should be used appropriately.
• Phishing & Spam: Protecting our members’ security is of very importance for us. Any attempt to share or send harmful content designed to compromise another user’s account or device is prohibited. Additionally, members should respect each other’s privacy and refrain from sending offers, queries, or suggestions that are not directly related to the Services or Orders in question.
• Privacy & Identity: Users are prohibited from sharing or posting others' private and confidential information. Any personal details needed to complete a service should only be exchanged within the Order Page. Sellers must ensure that any non-public information received from a Buyer is solely used for fulfilling the work and not for any other purpose. Users who choose to interact outside of My Freelancer will not be covered by our Terms & Conditions.
• Authentic My Freelancer Profile: You are strictly prohibited from creating a fake identity on My Freelancer, false personal details, setting up a profile for anyone other than yourself, or using another user's account or information. Your profile must accurately reflect your identity, including your description, skills, and location, and must not be misleading, illegal, offensive, or harmful. My Freelancer reserves the right to ask users to undergo a verification process (such as ID verification, phone number confirmation, or document submission) to access the site.
• Fraud / Unlawful Use: You are prohibited from using My Freelancer for any illegal activities or unlawful purposes, including attempting to bypass economic sanctions or trade restrictions set by the United States, the European Union, or any other relevant authority.
• Abuse and Spam: Users are permitted to have only one active My Freelancer account to prevent fraud and abuse. The creation of multiple accounts to bypass platform guidelines, gain competitive advantages, or deceive the My Freelancer community will lead to the suspension of account. Creating multiple accounts may result in the disabling of all associated accounts. Please note that violations of My Freelancer's Terms could lead to the permanent suspension of all related accounts.
• Targeted Abuse: My Freelancer does not tolerate any form of targeted abuse or harassment directed at other users. This includes the creation of multiple accounts with the intent of harassing or disturbing members via the messaging or ordering system.
• Selling Accounts: Buying or selling My Freelancer accounts is strictly prohibited.

Conflict Resolution and Support

• We encourage Buyers and Sellers to resolve any issues directly between themselves. However, if this is not possible or if you come across any prohibited activity on the Site, you can reach out to My Freelancer's Customer Support for assistance.

Content Review, Appeals, and Dispute Resolution

• My Freelancer is not obligated to routinely review user-posted content for legality or adherence to the Terms. However, we reserve the right to conduct voluntary checks to identify potentially illegal or non-compliant content and take appropriate action. If we identify or are informed of a violation of the Terms, we may take necessary steps.
• If any action is taken against your account or content, or if you disagree with a decision following a report, you have the right to file a complaint. Complaints must be submitted within six months from the notification of the decision. To submit a complaint, please contact our Customer Support and provide a detailed explanation of why you believe the decision should be reconsidered.
• We are committed to handling complaints fairly, objectively, and in a timely manner. If we determine that the decision was made in error, we will reverse it.
• We also reserve the right to decline cooperation with a Dispute Settlement Body if.
  • a. the dispute has already been resolved or is ongoing with the relevant court or another Dispute Settlement Body,
  • b. the six-month period for submitting a complaint has passed without action. Please note that the decisions made by Dispute Settlement Bodies are non-binding.

Confidentiality

• Sellers acknowledge that, while providing the Services, they may need to receive confidential information from Buyers. Sellers agree to treat all such information as highly sensitive and confidential, safeguarding it from unauthorized use or disclosure. Specifically, Sellers commit to the following:
  • a. To keep all information received from the Buyer in strict confidence.
  • b. To prevent disclosing any of the information to third parties.
  • c. To use the information only for work purposes.
  • d. To not copy any of the information without the Buyer’s prior consent.

User Generated Content

• User Generated Content refers to content uploaded by users, rather than content created by the Site itself. All content uploaded to the Site by users (both Buyers and Sellers) is considered User Generated Content. My Freelancer does not proactively monitor UGC for appropriateness, copyright, trademark, or other rights violations. User uploading or creating such content is solely responsible for it and for any consequences that may arise from its use, disclosure, storage, or transmission. By uploading or creating content on the Site, you confirm that you either own the content or have all necessary rights, licenses, permissions, and authority to use and upload it. You also guarantee that the content, or its use on the Site, does not:
  • a. Violate any intellectual property, proprietary, privacy, data protection, or publicity rights of any third party.
  • b. Break any applicable local, state, federal, or international laws, regulations, or conventions.
  • c. Violate any of your own or third-party policies, Terms & Conditions, or guidelines.
• We request users to report violations, accompanied by proof of ownership when applicable. Content that violates these terms may be removed or disabled.
• Additionally, My Freelancer is not responsible for the content, quality, or level of service provided by Sellers. We make no guarantees or warranties regarding the Services on My Freelancer, their delivery, or any communication between Buyers and Sellers. We encourage users to use our rating system, community feedback, and common sense when selecting services.

Commercial Use License

• By purchasing a "Commercial Use License" as part of your Order, the Seller grants you a perpetual, exclusive, non-transferable, worldwide right to use the delivered content for Approved Commercial Purposes. For clarity, the Seller keep back all ownership rights to the content. "Approved Commercial Purposes" refers to any business-related use, such as advertising, marketing, website creation, integration into products, software, or other business tools. It does not include any illegal, immoral, or defamatory uses. This license is governed by the Terms & Conditions of My Freelancer.
• Please note that there are no warranties, either express or implied, associated with the purchased delivery, including any warranty of fitness for a specific purpose. Neither the Seller nor My Freelancer will be held responsible for any claims, damages (including incidental or consequential), or other liabilities arising from the license, the delivered content, or its use.

Disclaimer of Warranties

• Your use of this site, its content, and any services or products offered here are at your own risk. Everything on the site is provided "as is" and "as available," without any guarantees, except where we have used reasonable professional care. My Freelancer and its partners, agents, or representatives do not guarantee completeness, security, reliability, quality, accuracy, or availability of the site.

Limitation of Liability

• Subject to the terms and conditions of this disclaimer, My Freelancer, its affiliates, service providers, employees, agents, officers and directors shall not be liable for any damage arising out of or in connection with your use of or inability to use this site or any linked sites. This includes actual or threatened physical or emotional harm, loss of earnings, use, savings, profits, or business, goodwill, or other consequential, special, or punitive damages of any kind. This is whether the loss is caused by negligence, breach of contract or otherwise or was reasonably foreseeable. This does not exclude or limit any liability where it would be unlawful to attempt to exclude or limit such liability.

Deactivating and Disabling Accounts

• My Freelancer reserves the right to suspend or permanently disable any account that violates these Terms, including issues such as poor-quality services, illegal activity, or inappropriate use of the Site and its services. A violation of My Freelancer's Terms may result in your account being permanently disabled, in which case you will no longer be able to buy or sell on My Freelancer, and any related content may be removed.
• Users may also choose to deactivate their account at any time through their account settings. However, users who deactivate their accounts will still be responsible for any outstanding payment obligations.
• Certain provisions of the Terms, particularly those related to Orders between Sellers and Buyers on My Freelancer, will remain in effect even after your account is deactivated or your access to My Freelancer is disabled.

General Terms

• My Freelancer reserves the right to modify these Terms from time to time. When updates are made, a revised version of the Terms will be posted on the respective page.
• By continuing to use My Freelancer after the Terms have been updated, you agree to the changes. If you do not accept the updated Terms, you must deactivate your account.
• Changes to these Terms may occur due to updates to the Site, changes in policies, the introduction of new services, modifications in features or functionalities, adjustments in response to changes in technology, or in response to legal or regulatory requirements. Additionally, changes may occur to address issues related to security and fraud.
